Advocates Program Terms & Conditions

1. Terms and Conditions

The NewBook Advocates Program (“Program”) offered by NewBook Pty Ltd (“NewBook”) has been created to reward you, our loyal advocates, (“you”, “Partner”, “Referrer”, “Participant”) for doing what you would already do – recommending us to other companies who sign on to be NewBook customers (“Referred”, “Participant”).

These Program Terms and Conditions are a binding agreement between you and NewBook and will govern your participation in the referral program. By participating in the Program, you agree to the Terms and Conditions and the Privacy Policy. You are not authorized to participate in the Program, if you do not agree to these Program Terms and Conditions in their entirety.

NewBook reserves the right to modify these Program Terms and Conditions at any time, at its sole discretion. NewBook may also, in its sole discretion, change, cancel, suspend, or modify any aspect of the Program without notice. NewBook also reserves the right to disqualify any customers or prospective customers at any time from participation in the Program for any, or no, reason.

2. NewBook Advocate Program Reward

• Referrer Reward: The Referrer will receive a $500 Visa or Mastercard Gift Card for each new Referred customer who becomes a NewBook client and is Live in the system for 3 months.
• Referred Reward: $500 off onboarding fees, which is waived on the initial invoice. The Referred’s NewBook subscription costs must equal to $5000 annually to participate.

Live is defined as the Referred having a) completed the setup of their PMS and b) paid in full, the Referred’s first invoice.

3. How the Program Works

NewBook sells Software Subscriptions for the use of its NewBook Property Management (PMS).

A Qualified Referral occurs when:

1. The Referrer submits their Referred’s details via the online form.
2. The Referred will go through the demonstration and contractual process with the sales team. Upon the Referred signing the contract within 30 days, they will receive $500 off onboarding fees
3. Once the Referred has completed 3 months Live with the NewBook system, the gift voucher will be payable to the referrer
4. The gift voucher will be paid to the Referrer as per the conditions below.

Live is defined as the Referred having a) completed the setup of their PMS and b) paid in full, the Referred’s first invoice. 

Eligibility

To be eligible for participation in the Program, both the Referrer and the Referred must be at least 18 years of age. The Referred customer must sign a 12-month contract and be Live in the system for 3 months before any gift voucher is paid. The Referred must be supplied as per the above and not already be a contact the NewBook team are in discussions with. The program is not applicable for current enterprise groups using NewBook who wish to implement NewBook in a new property. NewBook reserves the right to disqualify any Participant in the Program at its sole discretion. In the event that there is more than one referrer for the referred, NewBook will grant only one reward, which will be allocated to the first referrer. Â 

The Referred’s NewBook subscription costs must equal to $5,000 per year or more to eligible for this program.

Conduct

NewBook reserves the right, at its sole discretion, to prohibit any Partner from participating in any aspect of the Program if NewBook deems or suspects that such Partner has engaged in or has attempted to engage in any of the following:

1. a) acting in violation of these Program Terms and Conditions;
2. b) damaging, tampering with or corrupting the operation of the Program
3. c) activity deemed in the sole discretion of NewBook to be generally inconsistent with the intended operation of the Program.

NewBook shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Program Terms and Conditions or intent of these Program Terms and Conditions.

4. Liability

Binding Effects.​ By participating in the Program, you agree to and are bound by the Program Terms and Conditions. If you do not wish to agree to and abide by the Program Terms and Conditions in their entirety, you are not authorized to participate in the Program.

Release.​ By participating in the Program, Participants release NewBook, its parent company, subsidiaries, affiliates, suppliers, advertising, and promotions agencies and their respective directors, officers, employees, and agents from any and all liability for any loss, harm, damages, cost, or expense, including, without limitation, property damages, personal injury and/or death, arising out of or in any way connected to the Program and/or the use of any Program rewards.

Indemnification. ​Participants agree to indemnify, defend, and hold NewBook and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs, or expenses, including legal fees and costs, arising from, or related to any breach by the participant of any of these Program Terms and Conditions or any violation by Participant of applicable law.

5. Other Terms

General Terms.

These Program Terms and Conditions constitute the entire agreement between Participants and NewBook concerning Participants’ use of the Program. The failure of NewBook to exercise or enforce any right or provision of these Program Terms and Conditions shall not constitute a waiver of such right or provision.

The term of this Agreement will begin upon our acceptance of your Program application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party notice of termination. Notice by e-mail, to your address on our records, is considered sufficient notice to terminate this Agreement.
